Overview

The Court of Common Pleas is required to be in continuous session on Election Day, from 7 a.m. to 10 p.m., in order to deal with any potential election issues that may need its attention. 25 P.S. § 3046.  It also continues to sit afterwards if it appears necessary to correct issues with the tabulation and canvass of votes. 25 P.S. § 3046.

Emergency Power to Suspend Voting

During natural disasters or emergencies, Pennsylvania law does not provide the executive branch with express procedures or powers to delay or postpone elections that are affected by the circumstances. However, the Court of Common Pleas is empowered to suspend voting in an election in the event of a natural disaster or emergency. 25 P.S. § 3046. Also see General Election-1985, 109 Pa. Commw. 604, 531 A.2d 836, 1987 Pa. Commw. LEXIS 2508 (Pa. Commw. Ct. 1987). In order for the court to consider this action, the Governor must first make an emergency declaration by executive order or proclamation. Pa. Const. Art. IV, § 20(a).
